What Employees Facing Disability Discrimination Should Know

You have been working for the same company for years and have even been promoted to a management level position. Things were going fine until you recently suffered a serious injury. On top of that, while being treated your physician diagnosed you with a serious ailment. You are dealing with both the disability and health issues and this has taken a toll on you both emotionally and physically.

Yet, instead of providing reasonable accommodations you find your employer is throwing everything at you to make things harder and even impossible to do your job.

Protection Under State And Federal Laws

As someone likely facing disability discrimination in California, you should know that there are both state and federal disability laws that protect you as the employee. Under federal law, the Americans with Disabilities Act (ADA) provides protection for employees against discrimination and retaliation. In California, the Fair Employment and Housing Act (FEHA) also provides protections.

These laws make it illegal for an employer to take certain actions (or in some cases take inaction) due to an employee's disability. Some of these actions include failing to provide reasonable accommodations for the disability, harassing or allowing the harassment of an employee because of their disability as well as firing or demoting an employee because of their disability.

It is important to understand your legal options thoroughly if you believe you are being discriminated against at work because of your disability. Every situation is different so it is in your best interests to seek your own legal counsel in California as soon as possible.
